Economic Espionage Act

Definition:
A U.S. statute, adopted in 1996, which provides criminal penalties for the theft of trade secrets. The EEA makes it illegal to steal or fraudulently obtain trade secrets for the benefit of a foreign government, instrumentality, or agent and steal trade secrets that benefit "anyone other than the owner."

Universal Copyright Convention

Definition:
The UCC was created in 1952 through UNESCO to provide an international multilateral copyright treaty; the UCC remains significant in the countries that are UCC but not Berne Union members.

Gray Market Goods

Definition:
Goods legitimately manufactured overseas, bearing a genuine trademark, but then imported by a party other than the trademark holder or authorized importer.

Cancellation Proceeding

Definition:
A proceeding before the Trademark Trial and Appeal Board in which the plaintiff seeks to cancel an existing registration of a mark. The proceeding may only be filed after issuance of a registration. A petition for cancellation may be filed by any person who believes that he or she is or will be damaged by the registration of the mark.

Publisher Statement

Definition:
Text printed in each issue of a serial providing information such as the publication name, owner, staff, and frequency. This is generally found within the first few pages of text.

Geneva Phonograms Convention

Definition:
Known formally as the Convention for the Protection of Producers of Phonograms Against Unauthorized Duplication of Their Phonograms.
